These General Terms and Conditions apply to all orders and shipments that take place between Brand Breeder S.r.l. (hereinafter, the "Seller") and its customers through the website www.brandbreeder.it (http://www.brandbreeder.it) (the "Site").
1. Placing an order
By clicking on one of the products displayed on the Site, the customer is taken to the relevant tab with the details of the article. By setting the desired quantity and clicking on the shopping cart symbol, the selected product will be placed in a virtual shopping cart.
By clicking on the "Shopping Cart" item at the top right of the screen, the customer displays the goods selected up to that point and has the option of modifying them.
When the already registered customer wants to finalise the purchase, he can log into his account and use the data saved there for the current order. New customers can decide whether to register and thus create their account or to continue without registration by entering the shipping address and order summary in the following screens.
When viewing a preview of the order, complete with prices, including VAT, and delivery options and costs, the customer must click 'Buy' to close the order.
2. Conclusion of contract
By clicking on 'Buy' the customer sends the seller a binding offer to conclude a purchase contract. The customer then receives an automatic e-mail confirmation of receipt of the order. This confirmation does not yet represent acceptance of the offer. The contract is concluded with the dispatch of the goods to the customer by confirmation by e-mail.
3.Limitation of quantities
The Seller reserves the right to limit the maximum quantities of each product that may be purchased at any time.
4. Prices
All prices are inclusive of Italian VAT and the Seller reserves the right to change them unilaterally at any time.
5. Methods of Payment
Payments may be made by credit and prepaid cards, bank transfer and Paypal. In the event of payment by bank transfer, the copy of the bank transfer shall not be accepted for the purposes of processing the order and the goods shall only be sent once payment has been received at the bank details provided by the Seller.
6. Shipping and delivery
Goods shall be shipped within 2-3 working days following receipt of payment.
Shipments are entrusted to an express courier to whom the purchaser can turn in the event of delays or inefficiency.
Upon dispatch of the goods, the customer will receive an e-mail from the courier used with the corresponding references for tracking.
The customer shall notify the Seller's Customer Service of any damage to the goods during transport.
If, due to problems beyond his control, the Seller is unable to dispatch the ordered goods, he may terminate the contract. Where possible, he shall offer the customer a replacement product and, in the event of the customer not being satisfied with the same, the Seller shall refund the amount already paid by the customer.
Shipments within the European Union are exempt from customs duties. Any customs duties, taxes or ancillary charges for shipments to non-EU countries shall be borne by the customer.
7. Consumer's Right of Withdrawal
In accordance with the provisions of the law in force, the term "consumer" shall mean any natural person who, in contracts covered by this Directive, is acting for purposes that are outside his or her trade, business, craft or profession.
The consumer has the right to withdraw from the contract, without giving any reason, within 14 days from the moment he acquires physical possession of the goods, including through a third party other than the carrier.
In order to exercise the right of withdrawal, the consumer must send an explicit statement of intent by e-mail to the contacts indicated on the Site and must return the goods within the following 14 days to the following address: info@brandbreeder.it or amministrazione@brandbreeder.it.
The exercise of the right of withdrawal shall entail the reimbursement of the payments made in favour of the Seller, who reserves the right to suspend it until receipt of the goods.
The cost of returning the goods shall be borne by the customer, who shall be liable for any decrease in the value of the goods resulting from handling the goods other than what is necessary to establish the nature, characteristics and functioning of the goods.
The right of withdrawal does not apply to the supply of: any goods that are not prefabricated, produced on the basis of an individual choice or decision of the consumer, made-to-measure or clearly customised, the supply of goods that are liable to deteriorate or expire rapidly, sealed goods that are not suitable for return for hygienic or health protection reasons and have been opened after delivery, goods that are, by their nature, inseparably mixed with other goods after delivery.
8. Online dispute resolution for consumers
The European Commission has set up an online platform that provides European consumers with an alternative dispute resolution tool for disputes relating to and/or arising from contracts for the sale of goods and services concluded online. 9. Privacy policy
The customer, by entering his/her e-mail address in the appropriate form on the Site or by shopping on the Seller's Site as a registered user will become part of the Seller's database.
The data controller is Brand Breeder S.r.l. (the "Data Controller"). In the performance of the service, the Owner may make use of carefully selected suppliers specifically appointed as Data Processors.
The customer's personal data shall only be processed, in the proper execution of pre-contractual measures, to manage his request or purchase. Furthermore, the Seller may send the customer communications, again by e-mail, to propose offers or promotions.
The customer's data will not be disclosed or communicated to third parties and will be kept for the time necessary to manage his request. The provision of the data is optional, however if it is not provided, the Seller will not be able to handle your request.
The customer is granted the rights set out in Articles 15 et seq. of EU Reg. 679/2016, including the right of access, rectification, cancellation, restriction of processing and portability. To exercise his rights he may write to the following e-mail address info@brandbreeder.it.
10. Final provisions
The invalidity of any of the provisions contained in these General Terms and Conditions shall not affect the validity of the contract itself. This contract is governed by Italian law and for any dispute relating thereto the Court of Rome shall have exclusive jurisdiction.
The Customer declares that he/she has fully read and understood all the above clauses, and that he/she specifically approves, also pursuant to and for the purposes of Articles 1341 and 1342 of the Italian Civil Code, the following clauses: 2, 3, 4, 6, 10.
